MOJ possession data - another fall

Figures from the Ministry for Justice show possessions have fallen again.

Figures for Q1 2017 were 35,188; 8% less than Q1 2016, the eight quarterly fall in a row.

Broken down, there were 26,009 Orders of Possession, (down 10% on last year), 17,936 Warrants of Possession (down 9% on last year), and 9,370 Repossessions by county court bailiffs, (15% down on last year) 

The MoJ says these falls continue a trend started back in 2014.

BTL repossessions/arrears remain low

Mortgages arrears remain low according to data from the Council of Mortgage Lenders. 

The CML report arrears for Q1 2017 fell from the previous quarter.

There were 92,600 resi-mortgages in arrears, 0.84% of all mortgages, the lowest quarterly rate on record.

Q1 2017 saw BTL mortgage arrears over 2.5% of outstanding balance remain stable at 5000, with just 700 BTL properties repossessed during the period.

BTL repossessions fall to just 500 in June

The Council of Mortgage lenders have reported another fall in repossessions. The CML's June data saw BTL property repossessions fall from 700 in May to 500 during June. This fall in repossession is a continuation of the downward trend across both BTL and owner occupier properties.

Possessions down by 10%

The Ministry of Justice - 'Mortgage and Landlord Possession Statistics in England and Wales ' for Q1 2016 show a fall in landlord repossessions.

The MOJ reports county courts heard 38,053 landlord possession claims, down 10% compared to  Q1 2015.

Of these cases, 63% involved social landlords.

Mortgage possessions also fell, with county courts seeing 4738 mortgage possession claims during Q1 2016, down 16% on Q1 2015.

CML see drop in repossessions

According to Council of Mortgage Lenders data UK residential property repossessions are at a nine-year low.

The CML report that 2014 saw a total of 21,000 repossessions, 26 % less than 2013 which recorded 28,900.

Of the 21,000 properties repossessed in 2014 just 4,900 were BTLs.

The report also showed a fall in mortgage arrears to its lowest rate since 2006, with just 1.05 of all mortgages in arrears.

Paul Smee, CML director general, commented

“No-one should be lulled into a false sense of security that the current low interest rates we are experiencing will last forever, though. Rules are in place to ensure lenders assess future affordability, but these are not a substitute for careful borrowing.”

Possession orders and human rights

A recent case has highlighted the fact that a tenant cannot invoke the Article 8 Convention on Human Rights to over rule the powers of a private landlord the rights of possession under 21(4) of the Housing Act 1988.  The case McDonald and Others vs McDondald involved a couple granting an AST to their disabled daughter in breach of the mortgage terms.
