Landmark leasehold case fails to cut extension costs

"The Association of Leasehold Enfranchisement Practitioners (ALEP) has been eagerly awaiting the outcome in the Appeal of the so-called ‘Mundy’ case, (Mundy v. the Trustees of the Sloane Stanley Estate).

The Court of Appeal has dismissed the appeal made by tenants in this case. The applicants were seeking to argue for a radically different way of calculating relativity, following on from their unsuccessful attempt to encourage the Upper Tribunal to do so in the original decision of that tribunal.

This decision has been much anticipated and there has been a lot of recent comment, suggesting that if the Court of Appeal had sent this case back to the Upper Tribunal that this may have been very good news for leaseholders as there may have been scope to see the tribunals adopting a view of relativity that would have reduced the cost of lease extensions and freehold purchases where leases are under 80 years and marriage value applies.

What is clear is that the decision confirms that the position of leaseholders whose leases are about to fall under 80 years, or have already done so, remains one where action is required. One crucial message that ALEP has striven to get across during its 10 year history, that leaseholders should not let the length of their lease fall below this mark, so the value of the property is protected.

We would therefore encourage anyone in need of professional advice to make contact with ALEP to locate a member who can help them through the complexities of extending their lease or buying the freehold.

Awareness of leasehold is at an all-time high, and today's ruling will further highlight the issue.

"he outcome will no doubt be seen as a blow to those who have been campaigning to see changes in the leasehold system and we cannot ignore the growing ground swell of consumer and political opinion that is now seeking changes to the leasehold system.

However, what is important to note is that, notwithstanding the outcome of the ruling from the Court of Appeal, the government has in the outcome of the recent consultation on ‘Tackling Unfair Practices in the Leasehold Sector’ and other recent announcements indicated that it wants to look at many things, including making it easier for flat owners to enfranchise and also to ‘simplify’ the valuation process. Indeed, the Law Commission is going to be asked to look at this as part of the proposals from government."

New mortgage lending increases by 84% at Paragon


  • Mortgage lending up 84% to £367 million in first quarter

Paragon Banking Group today reported a 65% year-on-year increase in new advances across all business lines to deliver £470 million of new lending in the first quarter of 2018.

Within this total, Paragon’s mortgage lending grew by 84% to £367 million, with buy-to-let advances up 85% to £343 million. Second charge and specialist residential lending grew by 74% to £24 million.

In the buy-to-let market, Paragon’s experience and capability enabled it to increase its share of more specialist, portfolio landlord business despite a backdrop of lower year-on-year lending volumes in the market overall.

This follows the implementation of the PRA’s new requirements for underwriting more complex mortgage applications in September 2017 which led to a realignment of competition with some mainstream lenders exiting the portfolio segment or offering only a limited proposition.

The mix of Paragon’s buy-to-let completions in the quarter included 66% of loans to landlords with more complex portfolios. The impact of the PRA underwriting rule changes from September had a more profound impact on application flows during the quarter, with the mix in the pipeline at 31 December 2017 moving to 79% complex. The pipeline rose from £604 million at 30 September to £619 million at the end of December.

The Group also demonstrated strong progress in its strategy to deliver greater diversification. Paragon grew first quarter commercial lending by 21% to £103 million as it continued to develop of its franchise. Paragon also maintained strong progress in deposit raising, with savings balances exceeding £4 billion at the quarter end, up 98% from £2 billion at 31 December 2016.

It is very well aligned with the developments we have seen in the market following changes in government policy and regulation in the sector and this has allowed Paragon to significantly increase lending to portfolio landlords with more complex requirements.

“We are continuing to focus on product and technology developments that will deliver improved products and services to our landlords and intermediaries with the roll-out of new mobile applications and document upload over Q2.”
