Campbell Robb, chief executive of Shelter said: “We are against fees to tenants because they are already charging the landlords. This is a dysfunctional market. It doesn’t work anywhere else where you get paid twice, effectively for the same service.”
The Agents' practice is wrong. Here's why:
ReplyDelete1. The Landlord (L) enters into two Agreements:
a. one with the Letting Agent (A), the Agency Agreement; and
b. one with the Tenant (T), the Letting Agreement.
2. A has just one contract- the Agency Agreement- and it's with L. Significantly, T is not a party to it.
3. So T has no obligations to A- esp. no obligation to pay A's fees in acting for L.
